Hate Crimes: Combating Gay &
Transgender "Panic" Strategies

July 20 – 21, 2006

'Panic' strategies have been used by criminal defendants to claim that their culpability for committing homicide or violent assault is mitigated when the victim is a lesbian, gay or transgender person.

This multitrack conference will instruct prosecutors, peace officers, investigators, victim/witness advocates and representatives of community-based organizations on: countering “panic” strategies from the investigatory phase through trial; seeking hate crime enhancements and addressing the problems often encountered; victim services; and restitution.

“ 'Panic' strategies have been raised in homicide and assault cases nationwide, inviting jury nullification and attempting to justify violent crime based upon the identity of the victim. These strategies have allowed dangerous criminals to commit violent acts and receive little more than a slap on the wrist. This conference will provide law enforcement officers, prosecutors and the communities we protect with the tools, experience and information needed to dismantle the myth that these strategies constitute a legitimate legal defense.”
